Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Tuberlogic ("we", "us", or "our"), the developer of SpudScout ("the App"). By accessing or using SpudScout, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

Description of Service

SpudScout is a professional iOS application designed for potato crop scouting, providing:

• Field scouting session recording including disease, insect, weed, agronomic, and field issue observations
• A comprehensive potato disease identification reference guide
• GPS-based field location capture and tracking
• Scouting reports and export functionality

The disease identification guide is available free of charge. Full scouting functionality requires an active SpudScout Pro subscription.

Subscriptions and Billing

SpudScout Pro is available as an auto-renewable subscription:

All subscriptions include a 14-day free trial for new subscribers. Subscriptions are processed and managed entirely through Apple's App Store. By subscribing, you also agree to Apple's terms and conditions.

Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Apple ID account settings. We do not offer refunds for partial subscription periods, though Apple's standard refund policies apply.

Acceptable Use

You agree to use SpudScout only for lawful purposes and in accordance with these Terms. You must not:

• Use the App for any unlawful or fraudulent purpose
• Attempt to reverse engineer, decompile, or disassemble any part of the App
• Use the App in any way that could damage, disable, or impair its functionality
• Attempt to gain unauthorised access to any systems or networks connected to the App
• Use the App to collect or store personal data about other individuals without their consent

Intellectual Property

SpudScout and all of its content, features, and functionality — including but not limited to the disease identification guide, photographs, text, graphics, and software — are owned by Tuberlogic and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use SpudScout on your personal iOS device for your own professional agricultural scouting purposes. This licence does not include the right to reproduce, distribute, modify, or create derivative works from any part of the App.

User Data

All scouting data you create within SpudScout is stored locally on your device. We do not access, collect, or transmit your scouting records, field data, or observations to our servers. You are solely responsible for maintaining backups of your data. Deleting the App will permanently remove all locally stored data.

Our handling of any data is governed by our Privacy Policy, which forms part of these Terms.

Accuracy of Information

The disease identification guide and agronomic information provided in SpudScout is intended as a general reference tool for professional agronomists and crop scouts. While we make every effort to ensure the accuracy of this information, we cannot guarantee that it is complete, current, or applicable to every situation.

SpudScout is not a substitute for professional agronomic advice. Always consult qualified agronomists and local extension services when making crop management decisions. Tuberlogic accepts no liability for crop losses or damages arising from reliance on information provided within the App.

Disclaimer of Warranties

SpudScout is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses or other harmful components
• Any defects or errors will be corrected
• The results obtained from using the App will be accurate or reliable

To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, Tuberlogic shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, crop losses, data loss, or business interruption — arising from your use of or inability to use SpudScout, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of SpudScout shall not exceed the amount you paid for your most recent subscription period.

Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue SpudScout or any part of it at any time, with or without notice. We also reserve the right to update these Terms at any time. When we make material changes, we will update the effective date at the top of this page. Your continued use of SpudScout after any changes constitutes your acceptance of the revised Terms.

Termination

We reserve the right to suspend or terminate your access to SpudScout at our sole discretion if we believe you have violated these Terms. You may terminate your use of SpudScout at any time by cancelling your subscription and deleting the App from your device.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Idaho.

Apple App Store Additional Terms

SpudScout is distributed through Apple's App Store. As such, these Terms are between you and Tuberlogic only — not Apple. Apple has no obligation to provide any maintenance or support for SpudScout. In the event of any failure of SpudScout to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. Apple has no other warranty obligation with respect to SpudScout.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
